Louisiana pedestrian killed by pickup on shoulder of road

Drivers are required to apply appropriate care in their actions on the road. This is especially important when sharing the road with pedestrians. Pedestrians typically are subject to more significant injuries in these accidents as they have a relative lack of safety features as compared with vehicles, which can create more extensive liability for those at fault.

A recent collision in Louisiana involving a pickup and a female pedestrian resulted in the death of the woman. According to authorities, the pedestrian was walking along the shoulder of a roadway when the car accident occurred. The driver of the pickup is alleged to have driven outside of his lane on the road, causing the collision. The pedestrian, who was campaigning for a local politician at the time of the accident, was taken to a nearby hospital for treatment, but died as a result of her injuries.

When drivers and pedestrians share the road with one another, each party owes a duty of safety. The driver must apply reasonable care in his or her actions to avoid creating a dangerous situation for the pedestrian, while the pedestrian is required to reasonably anticipate dangerous conditions and use appropriate care to avoid the consequences. If either party fails to meet his or her respective duty, he or she could be subject to liability for any ensuing injuries or have any potential compensation minimized or completely negated as a result of his or her actions. Examples of such actions by a driver might include speeding, driving while intoxicated, distracted driving and disobeying traffic signals, among others. On the other hand, pedestrian actions that may result in contributory negligence include failing to use crosswalks when available, inappropriately entering traffic and ignoring pedestrian traffic signals.

Drivers and pedestrians alike have certain responsibilities on the road regarding each other. If either party fails to meet these obligations and cause injuries to others, he or she may be subject to significant financial liability as a result. Those who are injured in such an accident should be aware of their rights to compensation and the proof that is required to show liability.
