On Behalf of | Jul 30, 2014 | Premises Liability

When patrons of stores in Louisiana and other states across the country shop they expect that the conditions will be safe and that they will not be injured as they complete the purpose of their trip. If someone is injured on another person’s property they may be entitled to compensation. A woman who was recently injured at a Sam’s Club store in Louisiana has sued the massive retailer for her injuries.

According to the woman’s lawsuit, she was shopping at a Sam’s Club location in October of 2013 when she encountered an empty pallet sitting on the floor. She wanted to get to something behind the pallet so she tried to step over it to reach the goods that were stored behind it.

As the woman tried to step around the pallet she slipped and fell. She claims the she struck her head violently on the pallet and fell to the ground where she also hit her hip. As a result of the fall she has suffered injuries to her hip, head and arms.

The woman has sued the retailer for the injuries caused by this dangerous property condition. Her lawsuit asks for monetary damages of an unspecified amount to cover pain and suffering, loss of wages, medical expenses, scarring, loss of enjoyment of life, disability, disfigurement and loss of earning capacity.

When an individual is injured by hazardous conditions on another party’s property the most common way that they can recover the type of compensation sought in this woman’s case is by filing a premises liability lawsuit. It is important that property owners are providing a safe area for visitors and providing proper warnings of any unsafe conditions. If they do not, they can be held accountable for their lack of care.
