Property owners, or those responsible for maintaining or ensuring the safety on a piece of property, have a responsibility to others to prevent or correct dangerous property conditions. The level of care that is owed to others entering the property is based on their classification as a licensee, invitee or trespasser.

At a high level, property owners should fix any potentially dangerous conditions on their property that they are aware of, or should be aware of based on inspection of the property or comments by others using the property. When they fail to fulfill this duty, they risk serious injury to others and may expose themselves to significant liability as a result. Some of the more common circumstances that may give rise to a premises liability claim include slip and fall accidents, those caused by improper lighting, negligent security or falling items.

As the property owner or maintainer is usually in the best position to know of these dangers and correct them, they are considered liable under certain circumstances that arise based on their negligence or willful failure to act.
